Likeness and takedown policy
This page is for anyone who believes that their face or photo was used in YourBuddyfy without permission, or who wants to report other illegal content. It also explains to users what happens when their content is reported.
In short
- A buddy may only be made from the user's own photo or from the photo of an adult who agreed. Users declare this before every upload and are responsible for it.
- If your likeness was used without your permission, write to devtaskhub@devtaskhub.com with the subject "Takedown request".
- Tell us what you know so that we can find the content. A person reads every report and we act expeditiously.
- To check a report, the operator may view the head image of the reported buddy, never the original photos. Every view is logged with the reason.
- We can remove the buddy, suspend or close the account and revoke a licence. The account holder is told why by email and can send a counter notice within 14 days.
- You do not need an account to report, and reporting is free.
This summary is here to help you. The full text below is what applies.
1. How photos are used in the Service
In YourBuddyfy a user uploads a photo, and the head is cut out and placed on a drawn body to make a cartoon buddy. The buddy acts out pretend activities and playful slapstick jokes that the user picks or triggers. It appears only on that user's own screen, in the browser or on the desktop. There is no public gallery, no sharing feature and no way for other users to see it.
Users may upload only a photo of themselves or of an adult who gave permission. Before every upload the user must tick a declaration confirming this, and the server refuses uploads without it. We keep a record of the declaration.
We store this content privately at the user's request. We do not select or approve photos, we do not look at them as a matter of routine, and we cannot verify declarations in advance. That is why this procedure exists.
2. Who can send a report
Anyone can send a report. You do not need an account. Typical cases are:
- you believe someone made a buddy from your photo without your permission, or you gave permission and now withdraw it;
- you are the parent or guardian of a person under 18 whose photo was used;
- a photo was used that you hold the copyright in;
- you know of content in the Service that you consider illegal for another reason.
3. How to report and what to include
Send an email to devtaskhub@devtaskhub.com with the subject line "Takedown request". You can write in Greek or in English. Please include:
- your name and an email address where we can reach you. If the report concerns a suspected offence involving the sexual abuse of a minor, you may report without giving your name;
- what the report is about and why you consider the content illegal or used without permission, for example that the photo shows you and you did not agree;
- everything that helps us find the content. Since buddies have no public address, tell us what you know: the name or email address of the person you believe made the buddy, how you learned about it, and a screenshot or recording if you have one;
- if you report in your own name that your likeness was used, something that lets us see that you are the person shown, such as a description of the photo. Do not send identity documents unless we ask for them;
- a statement that you believe, in good faith, that the information in your report is accurate and complete.
We confirm that we received your report without undue delay.
4. What we do with a report
A person reads every report. We do not use automated tools to decide on reports. We handle reports in a timely, diligent and objective way, and we act expeditiously once a report gives us actual knowledge of illegal content or of a breach of our rules.
To check a report, an authorised administrator may look at the head image of the reported buddy. This is the cut out head that the buddy shows, never the original reference photos. It is viewed solely to handle the report, for example to compare it with what the report describes. Each view is recorded in a log together with the reason. Only the operator has this access.
If the report is sufficiently precise and substantiated, we may do one or more of the following:
- suspend the account while we look into the matter, so that its buddies cannot be used;
- remove the buddy, together with its photos, its cut out head and its related data;
- sign the account out on all devices;
- revoke a licence;
- close the account, in particular for serious or repeated breaches;
- ask the account holder to show that they had permission.
In clear cases, such as a credible statement by the person shown that they never agreed, or any content involving a minor, we remove the content first. We do not ask the person shown to prove that they did not consent.
When we remove a buddy, the account holder is told by email.
We tell you what we decided and how you can challenge the decision. If we cannot find the content with the information given, we will ask you for more.
5. Information for the account holder and counter notice
If we remove a buddy, suspend or close your account, or revoke a licence, we send you a statement of reasons by email. It says what we did, the facts we relied on, whether the decision is based on the law or on our terms, and how you can respond. We do not reveal the identity of the person who reported unless this is necessary and lawful.
If you believe the decision is wrong, you can send a counter notice to devtaskhub@devtaskhub.com within 14 days. Explain why the content was allowed, for example by showing that the person shown gave permission, or that the photo shows you. We then look at the matter again with fresh eyes. If your counter notice is justified we restore the content, where it still exists, lift the suspension and restore the licence.
A buddy that has already been removed, for example on an erasure request from the person shown, cannot be restored. You may make it again only if you hold a valid permission. What happens to a licence in that case is set out in the Terms of Service.
6. Misuse of this procedure
Please report only what you honestly believe to be true. We may stop handling reports from a person who repeatedly sends reports that are clearly unfounded. Knowingly false reports or counter notices may make the sender liable for the damage they cause.
7. Your data protection rights
If a buddy was made from your photo, you are also protected by data protection law. You can ask us whether we hold your photo, object to it being stored and ask for it to be erased. A takedown request from the person shown is treated as such a request as well. The Privacy Policy, in the section for people who appear in a photo that someone else uploaded, explains this.
To handle a report we process the data in it, including your contact details, and keep a record of the report and of our decision for as long as needed for the matter and for possible legal claims. We share your details with the account holder only where this is necessary and lawful.
Each time an administrator views the head image of a reported buddy, and each measure we take, is recorded in an administration log. The Privacy Policy explains what the log holds, who can see it and how long it is kept.
